Have you considered using a photodiode/phototransistor as a receiver? The photoresistors you use take a slightly longer time to adjust to light changes.
Now you just have to build a 38kHz IR tranzmitter in place of the laser and use that with a modulated receiver to decrease the effect of ambient light on the circuit.
